Today was the first day of the penalty phase. It wasn’t supposed to start until November 15, but two of the witnesses need to go home to Washington State, and since everyone was available now, they were taken out of order. In this part of the process, the prosecution and defense both present witnesses and evidence of mitigating or aggravating circumstances. Testimony about the character and background of the defendant and the victims is presented. It starts up again November 15.
There is a hearing November 9 to argue a motion by the defense.
